Tioga DA Working On Cal Harris Case Appeal

An appeal is in the works after a judge freed convicted killer Cal Harris.

District Attorney Gerald Keene filed initial paperwork in Tioga County Court, called a "notice of appeal."

Keene now has 9 months to file a full appeal with the state Supreme Court.

In November, Judge Martin Smith overturned a jury's guilty verdict after a new witness came forward.

Harris was set free on bail.

He was convicted of killing his estranged wife Michele, even though her body was never found.

Defense attorney Joseph Cawley will hand over the case after winning election as Broome County Court Judge.

Cawley tells Action News he's considering other attorneys and will make a decision by January first.
