Sherburne Man Charged With Murder

A night of fun and drinking turned deadly early this morning after one man is shot to death, another charged with his murder.

It happened at a Chenango County apartment complex.

23 year-old Josh Story of Sherburne is charged with murder.

The Chenango County Sheriffs Office says he used a shotgun to kill 24 year-old Kallin Richards of New Berlin.

Police say the shooting happened here, outside Story's home, in the parking lot of the Sherburne Meadows apartment complex.

Richards was shot while sitting in his SUV.

"The driver side window was blown out. The man was, suffered a gun shot wound. We later learned that he died as a result of the gun shot wound," said Chenango County Sheriff Thomas Loughren.

The Sheriff says two 9-1-1 calls led them to the scene.

Shortly after arriving they arrested Story in his apartment.

"Obtained a search warrant, recovered a 12 gauge shotgun, and one spent cartridge," Loughren said.

Police say before the shooting the men got into a fight in the parking lot.

That's when Story went back into his apartment to grab his shotgun.

"Neighbors say Richards was attempting to drive away when he was shot. The Sheriff says the SUV coasted about 200 yards before striking these trees."

Next door neighbor, Jade Sheldon, says Story had only been living in the apartment for about a week.

Sheldon says the two men were friends.

She saw them drinking together earlier in the night at the Honky Tonk Saloon down the street.

"They came, brought the party back from the bar," Sheldon said.

A party that ended in tragedy.

Story was taken to the Chenango County Jail without bail.

A hearing is set for Thursday evening at 7 in the Town of Sherburne Court.
