A New York State Appeals court says the murder conviction of Vernon Parker will stand.
38 year Parker is serving a life sentence without parole.
He and a second man were convicted of murder for the shooting deaths of Valerie Spears and her daughter Devin.
The 2 women were found shot in their home on South Washington Street in 2002.
Parker appealed in January, saying the jury pool should have been dismissed after the state's death penalty was thrown out during his jury selection.
The appeals court ruled it was right to hold the jurors, upholding his conviction and sentence.
