State Police determined Smith was driving at least 60 miles per hour when the bus crashed in a construction zone on Interstate 81, on May 20th.
Troopers say the Show Me Coaches tour bus also had bad breaks, some were worn and others broken.
32 year old Jonathan Randall, 39 year old Wayne Bonsell and 30 year old Jason Pessoni all died.
They worked for Economy Paving of Cortland.
The Broome County District Attorney's Office reviewed the investigation conducted by state police.
It directed State Police to issue the driver a ticket for speeding in a work zone, plus misdemeanor charges of failure to maintain a drivers log, and inadequate brakes.
The inadequate brake charge has not been filed yet.
Smith's arraignment is tentatively scheduled for December 14th in the Town of Chenango.
Smith is from Ozark, Missouri.
