Last Charge Filed Against Bus Driver

The crash killed 3 workers on Interstate 81 last May.
Today's arraignment for 58 year old Robert Smith of Ozark Missouri was postponed in Town of Chenango Court.

It wasn't until yesterday that State Police added a charge of having inadequate brakes.

They had already charged him with failure to maintain a drivers log and speeding.

Investigators say Smith was driving at least 60 miles an hour in a construction zone when his Show Me Coaches Tour bus crashed.

Troopers also say some brakes were worn, and other's broken.
Now that all charges have been filed, Smith's Attorney, John Blechman, tells Action News he will ask the court to let Smith plead not guilty by mail, rather than appear in person.
