Future of Endicott's Village Attorney

On Wednesday night, trustees voted to appoint a new village attorney, Michael Fauci.
Some trustees argued against the appointment, saying Fauci's appointment breaks the law.
"He doesn't pay village taxes, that's the difference. You live in the Town of Union, you pay town taxes and county taxes but you don't pay village taxes. If the criteria has been that you have to live in the village and pay village taxes in order to be the attorney for the village," says trustee Betty Havel.
Fauci lives at 2317 Country Club Road.
The problem is, his home is in the Town of Union, just outside the Village of Endicott line.
"Unless there was a local law that states the village attorney can reside outside the village, you have to follow New York State consolidated law which states you have to live within the village," says Havel.
But Endicott Mayor Joan Hickey Pulse says trustees didn't have a problem with former Village Attorney Rob Kilmer, who didn't live in the village either.
She says according the New York Conference of Mayors, anyone can fill the position of village attorney, regardless of where they live.
"The position of village attorney can be created in a village as a public officer or as position of employment so I am considering Mr. Fauci as an employee of the village. And as an employee of the village, he's not required to live in the village," says Pulse.
Havel says the Village usually waits until the first of the year to appoint a new attorney.
Pulse says the village faces many issues and she felt it was important to have a seemless transition from one attorney to the next.
Fauci and his father currently run a law firm on Washington Avenue in the Village of Endicott.
Pulse says she's quite sure that Fauci is up on the issues in the village and has no doubt he will do a good job for everyone.
