The Broome County Sheriff says the man who struck and killed a Port Dickinson police officer is under close watch.
30 year old Patrick Fitzgerald of Fenton is in the Broome County Jail's medical unit for observation.
Fitzgerald is charged with DWI and felony vehicular assault.
Sheriff David Harder says Fitzgerald was drunk when he ran into 40 year old officer Aldo Rossi in on Route 7 Sunday morning.
Harder says a breathalyzer test showed "very high" level.
Investigators are waiting for the results of a blood test before revealing Fitzgerald's blood alcohol content.
Sheriff Harder says Fitzgerald was working at the Relief Pitcher in Binghamton before the crash.
Investigators are still tracing Fitzgerald's actions while a work and after leaving the restaurant.
The case has been turned over to the Broome County District Attorney's office for further charges.
The Sheriff says medical watch for a suspect in a case like this is not unusual.
