On August 15, 2008, James K. Melious (23) and Eugene W. Mazza (32), both of Johnson City, New York, were indicted by a Broome County Grand Jury and charged in connection with a January 2008 incident in the Village of Johnson City.
Melious was charged with Assault in the Second Degree, which is a felony, and Resisting Arrest, which is a misdemeanor. Mazza was charged with Resisting Arrest and Obstructing Governmental Administration in the Second Degree, which are both misdemeanor offenses. The charges stem from an incident on January 31, 2008 on Willow Street in the Village of Johnson City when a police officer was injured while attempting to take Melious into custody under the Mental Health Law.
Assistant District Attorney Thomas D. Jackson, Jr. is handling the prosecution of the case.
An indictment is merely an accusation and is not evidence of guilt. As with every defendant in a criminal case, Melious and Mazza are presumed innocent unless and until they enter a plea of guilty or are proven guilty at trial beyond a reasonable doubt.
