A man accused of killing a police officer in a drunk driving crash rejects a plea deal.
30 year old Patrick Fitzgerald of Fenton appeared in Broome County Court.
Fitzgerald is facing 6 charges related to the death of Port Dickinson officer Aldo Rossi.
Rossi was struck and killed while directing traffic around a fallen tree lon Route 7 last July.
The Broome District Attorney's Office says Fitzgerald's blood alcohol level tested above .08%.
The DA offered Fitzgerald a plea deal to the most serious felony charge, Aggravated Vehicular Homicide and misdemeanor Aggravated Driving While Intoxicated.
It would carry a sentence of 5 to 15 years in prison.
Fitzgerald rejected the offer and will go to trial.
No date has been set.
The defense and prosecution will be file pre-trial motions over the next 4 weeks.
