Fitzgerald Sentenced to Five Years in Prison

31-year-old Patrick Fitzgerald pleaded guilty to aggravated charges of criminally negligent homicide and driving while intoxicated.

He was sentenced this morning in Broome County Court.

Investigators say Fitzgerald was driving with a blood alcohol level of point-37 percent.

He struck Port Dickinson Officer Aldo Rossi on Route 7 in Port Dickinson.

Rossi was outside of his patrol car talking to the driver of another vehicle when he was struck.

In addition to the 5 year prison term..

Fitzgerald received one year of probation, fines, and a 7 year order of protection to stay away from the Rossi family.
