Glen Aubrey Man Sentenced For Vehicular Manslaughter

Binghamton, NY (WBNG Binghamton) Nicholas R. Swan age 24 of Glen Aubrey, New York was sentenced to a state prison term of three to nine years for his conviction for Vehicular Manslaughter in the First Degree.

Swan was also sentenced to concurrent two to six years terns for his convictions for two counts of Vehicular Manslaughter in the Second Degree and a concurrent term of one year in jail for his conviction of Assault in the Third Degree and fined $1,000 fine for his conviction for Driving While Intoxicated.

Swan was convicted on December 15, 2009 after a non-jury trial conducted by County Court Judge Martin E. Smith.

The charges concerned a September 9, 2007 motor vehicle crash in which Swan operated a motor vehicle in an intoxicated condition and caused the deaths of his passengers Torrence Wilcox and Bobby Infante. A third passenger, Kimberly Demkovich, was injured in the wreck.

The case was prosecuted by Senior Assistant District Attorney Peter N. DeLucia.
