42 year old George Ford of New Jersey is in the Chenango County jail charged with 2nd degree murder.
A Chenango County grand jury indicted Ford on Wednesday.
Sheriff Thomas Loughren says Ford did not accidentally hit 12 year old Shyanne Somers of South Otselic.
Investigators used information from a GPS tracking system in the truck to track his actions on July 8.
Ford claimed he was driving the girl home around midnight.
He said they stopped by his pasture so she could look at his horse.
Ford said he accidentally struck Somers while turning the the truck around.
The GPS system showed Ford's truck was parked behind an abandoned home for about 3 hours.
The Sheriff would not say if he believes Ford sexually assaulted the girl.
Investigators believe Somers escaped and Ford followed in his truck.
They believe he intentionally ran over her while driving down hill on Warner Road in Otselic.
The say that was at 3:20 am.
The GPS shows Ford drove around Norwich before taking the girl's body to the hospital.
Defense Attorney Randel Scharf argues the GPS record could actually backs up Fords claims.
Scharf says it shows Ford did not leave the area after hitting the girl because he was in shock.
Ford will be arraigned on the 2nd degree murder charged on Monday.
