Ex-teacher's sex charges dismissed by Judge

Walton, NY (WBNG Binghamton) A judge in Delaware County dismisses the indictment accusing a former Walton High School teacher of having sex with two students.

Stephanie Fletcher of Walton was indicted in January 2013 and charged with two counts of rape, one count of criminal sexual act and two counts of endangering the welfare of a child.

Delaware County Judge Carl Becker said he dismissed the indictment because the Grand Jury did not receive one of the victim's written statements.

That statement said the victim was 17 at the time of the sexual encounters, which is the legal age of consent in New York.

"It appears this was an unintentional error," Judge Becker wrote in his Jan. 6th decision, "However, the result is that the Grand Jury did not have a material statement which directly impacted an element of the accusations made by one complainant against the defendant."

The Special District Attorney handling the case, Michael Breen of Middleburgh, has the option of presenting the information to another Grand Jury.

As of now, the case is closed in Delaware County Court.

Fletcher was a former Biology teacher at Walton High School. She was 28 at the time of her indictment.
