Binghamton, NY (WBNG Binghamton) A former Binghamton University basketball player was back in court Thursday.

DJ River is charged in Broome County Court with stealing a debit card and using it to buy clothes and a television at Wal-Mart in September of 2009.

He also tried to buy condoms at Manley's Mighty Mart in Vestal.

His attorney, Mark Rappaport, says he would like to be removed as counsel, because the two are not on the same page on what direction the case should go in.

An issue of payment was also discussed.

Judge Martin Smith told Rivera that if he wants to obtain a new lawyer, he must do so well in advance of his preliminary trial hearing.

That's scheduled for January 13, 2011.

Rivera was a guard on the BU Men's team that went to the NCAA tournament in 2008.

He was named the top player in the America East conference as well.

Rivera was one of 5 teammates that were kicked off the team.
