(WBNG Binghamton) The man accused of intentionally hitting and killing State Trooper Christopher Skinner will not appear in court Tuesday.

Almond Upton waived his right to a preliminary hearing.

It had originally been scheduled in Town of Chenango court for Tuesday morning.

The 60-year-old from Melrose, Florida is facing a first-degree murder charge.

He's accused of hitting the trooper with his truck on I-81 last Thursday.

If convicted, Upton could face life in prison without parole.
