Town of Walton, NY (WBNG Binghamton) A Florida man once charged with second degree murder for the death of a Walton man now faces a lesser charge.
According to freelance journalist Lillian Browne, a Delaware County grand jury indicted LeJuan Wainwright with manslaughter in the first degree Friday.
20-year-old Wainwright is accused of stabbing and killing 20-year-old Tyler Warner Saturday.
On Wednesday afternoon he was charged with murder in the second degree.
He pleaded not guilty to both charges.
If convicted, Wainwright could face 25 years in state prison.
If convicted on the initial charge, second degree murder, he would have faced life in prison.
"I asked the district attorney Richard Northrup. I had asked him whether he presented the case to the grand jury with the option of murder second. He said in fact he did but the grand jury chose to indict for manslaughter first," says Browne.
Before the stabbing, Wainwright was arrested in New York on a fugitive warrant.
He was released when Florida decided not to have him extradited, saying it was too costly.
Friends of Warner's spoke with Action News off camera.
They say they they are disappointed with the lesser charge.
Wainwright is now in Delaware County Jail on 100 thousand dollars cash bail.
