Jury Finds Fisher's Guilty

Jury Finds Fisher's Guilty

By WBNG News

A Town of Chenango jury finds Greg and Tammy Fisher are guilty of exposing their four year old child to cocaine.

Action News Reporter Caitlin Nuclo was in the courtroom today, and has reaction to the verdict.

The defense never denied that the Fisher's had drugs at their Airport Road home.

But argued all along that their son, 4-year-old Tyzon Fisher, never had access to them.

That wasn't enough to sway the 6 person jury in Chenango Town Court.

Which found Greg and Tammy Fisher guilty of a slew of charges, including drug possession and endangering the welfare of their child.

Back in September of 2007, State Police searched the Fishers home after their son had a seizure and was taken to Wilson Hospital.

The hospital reported a positive test for cocaine in his system.

The prosecution argued the Fisher's drug use put their child in danger.

But Defense Attorney Ronald Benjamin says they will continue to fight that charge.

"We made a motion to set that verdict aside. We'll continue to pursue that in connection with the endangerment issue. We don't feel that verdict was proper," said Benjamin.

A date has yet to be set for the Fisher's sentencing.

Benjamin says he plans to appeal part of today's verdict.
