Crash investigators take the stand as a murder re-trial starts its second week in Chenango County Court.

Peter Wlasiuk of Oxford is accused of murdering his wife in 2002.

Action News Reporter Gabe Osterhout tells us why investigators say there was no accident.

Two Chenango County Sheriff's investigators explained why they did not believe Peter Wlasiuk's version of events on the night his wife died.

The prosecution claims Peter suffocated his wife Patricia in their Oxford home, then drove their truck with her body inside into Guilford Lake.

Sgt. Richard Cobb investigated at scene.

Based on tire tracks, Cobb believes the truck made a turn from the right side of the road and drove a straight path down a bank and into the water.

Wlasiuk originally told police Patty was driving and swerved to avoid a deer.

Cobb says there was no evidence of a swerve.

Cobb adds Peter said he opened the passenger door to get out.

When truck was removed from the lake, both the doors were shut and locked.

Under cross examination, Cobb admitted that he never took tread prints from the scene to try to match to Wlasuik's truck.

He says there was not enough of the tread left at the scene for such a test.

Another investigator, Lt. James Lloyd, testified that Wlasiuk's story about a deer was odd because there aren't usually deer in that area.

He also pointed out there were no skid marks or turn marks on the grass.

Lloyd says that shows the driver of the vehicle made no effort to avoid driving the truck into the lake.

During his first trial in 2002 Peter changed his story to say Patty intentionally drove into the lake.

Wlasiuk was convicted of murder in 200 but the verdict was thrown out on appeal.

Testimony in his retrial will resume tomorrow morning at 8:30 am.

Also, one of the 4 alternate jurors was dismissed from this case due to an illness.
