The Chenango County District Attorney claims Peter Wlasiuk suffocated his wife Patricia at their home, then staged an accident in Guilford Lake, off Route 35.

Attorney Hugh Leonard questioned Peter Wlasiuk 2 months after his wife's death.

Leonard was hired by New York Central Mutual insurance company to investigate the reported accident.

Jurors heard a transcript of the interview.

Wlasiuk told Leonard that Patricia was driving and they argued.

He said his wife told him quote "I'm going to teach you. I'm going to drive into the lake."

Wlasiuk also claimed that Patricia might have "floored" the truck before going into the water.

In previous interviews, Wlasiuk says his wife tried to commit suicide in 2000.

Leonard says he denied the auto insurance claim because he did not believe there was an accident.

The company ruled the insured party was responsible for an intentional act, but did not specify Peter or Patricia.

Chenango County sheriff's deputies also took the stand.

They found Patricia hair in a tree branch in the family's backyard.

A similar branch was found in her hair.

But the defense argues the sheriff's office mishandled the evidence.

Claiming there is a lack of documentation of when the hair and branch were in police custody.

38 year old Peter Wlasiuk is from Oxford.

He was convicted in 2002.

The case was later thrown out on appeal.

The trial continues 8:30 tomorrow morning.
