Cal Harris Attempts Appeal For Second Conviction

(WBNG Binghamton) A Tioga County man serving 25 years to life for the murder of his wife has his appeal heard before the New York Court of Appeals.

In 2009, Calvin Harris of Spencer was convicted a second time for the death of Michele Harris.

She disappeared during the overnight hours of September 11, 2001 but no body was ever found.

Harris' attorney claims the trial court made series of errors to warrant a reversal.

That includes refusing to remove a juror who admitted having a preexisting opinion on the issue of guilt.

Also, a ruling to exclude written testimony of a witness who passed away before trial.

John Steele wrote in a letter that he had seen a woman resembling Michele and another man standing outside her home on the morning on September 12, 2001.
