Vestal, NY (WBNG Binghamton) A man claiming he was shot in the hand early Thursday was arrested and charged with assault.

Just before 3 a.m. Thursday, Vestal police say James Sutera, 46, called them and reported that he'd been shot.

When police responded to the home at 405 Brook Hill Ave., they found Sutera's girlfriend hiding by the road.

Police say she was injured.

She told police that Sutera had assaulted her and she fired a shotgun at him in defense.

Paramedics took the woman to Lourdes Hospital to be treated.

She was released later Thursday morning.

Sutera did not require treatment.

Officials charged him with assault in the second degree, a felony, and criminal mischief in the fourth degree, a misdemeanor, and sent him to Broome County jail pending further action.

A judge arraigned him in Vestal Town Court.

Sutera's girlfriend was not charged.
