Court Rules in Two-Town Dispute

(WBNG Binghamton) A ruling is handed down in a lawsuit between two local towns, but one town has plans to appeal the ruling.

The Appellate Division of State Supreme Court says the Town of Chenango has the right to continue to send treated water from its waste water plant into the Town of Fenton's side of the Chenango River.

A channel in the river has been the center of the lawsuit.

This comes after years of litigation between the two towns.

Fenton leaders were worried about how close Chenango's effluent was to an aquifer the town uses for drinking water.

"Our residents want us to move forward we want to move forward. It's a total injustice to the Town. We have to move forward. Its irrelevant what the cost is," says Fenton Town Supervisor, David Hamlin.

"One of the biggest concerns is both public and private water wells. We took steps in the Town of Fenton back in the day of councilmen like Bill Smith to pass an Aquifer protection law that was applauded by the DEC and EPA," says Fenton Town Council member, Mike Husar.

Chenango Town Supervisor Harold Snopek says, "I hope this will bring to an end the extensive litigation by the Town of Chenango and the Town of Fenton at a substantial legal expense to the taxpayers of both the Town of Chenango and the Town of Fenton."

The Town of Fenton plans to appeal the ruling.
