Johnson City man arrested for second DWI

Endicott, NY (WBNG Binghamton) A man was arrested for a felony DWI after a traffic stop early Tuesday morning.

A deputy with the Broome County Sheriff's Office spotted James Kurtz, 35, of Johnson City, driving erratically.

Kurtz was pulled over on Glendale Drive shortly after midnight.

Kurtz admitted to drinking alcoholic beverages earlier in the night, according to the Sheriff's Office. A further roadside investigation revealed that Kurtz was intoxicated, and had a small amount of marijuana on him.

A check of Kurtz’s driver’s license showed that it was suspended.

He was arrested and transported to the Broome County Sheriff’s Office for further processing. Kurtz’s B.A.C. was measured to be 0.20%.

Kurtz was issued tickets to appear in Town of Union court at a later date to answer to the charges.

Charges:
-Driving while intoxicated with a prior DWI conviction in the past 10 years, a class E felony
-Aggravated driving while intoxicated with a B.A.C. .18% or greater, with a prior DWI conviction in past 10 years, a class E felony
-Aggravated unlicensed operation of a motor vehicle in the 3rd degree, an unclassified misdemeanor
-Unlawful possession of marijuana, a violation
-Speeding in zone, a violation
-Improper left turn onto a two lane, a violation
