Waverly, NY (WBNG Binghamton) Fred Luther cast his ballot hoping to be the first democratic district attorney in Tioga County since the Civil War.

Luther cast his vote at the Waverly Village Hall on Ithaca Street.

He's running against Republican Kirk Martin.

Luther said he's confident he'll become the first democrat to be elected district attorney in more than 150 years.

"I'm very excited," Luther said. "I've got support from Republicans, Democrats, and independents because everyone wants justice and they want to elect the guy that's going to get justice done and put the criminals in jail."

Republican candidate Kirk Martin did not respond to calls from Action News as to where and when he would be voting.
