Owego, NY (WBNG Binghamton) A letter concerning the past of Tioga County District Attorney candidate Kirk Martin went out to residents in a bulk mailing. It was sent by Fred Luther, the Democratic candidate in the race.
The letter is a publicly available document filed with the Tioga County Attorney's Office. It's to Martin from former District Attorney Gerald Keene asking Martin to resign as an assistant district attorney in 2006.
Martin plead guilty to Driving While Ability Impaired after rolling his car over in the Town of Owego.
Keene's letter indicates Martin was pulled over 5 months earlier for suspected drunk driving. Keene wrote he was told Martin had resisted getting out the car and cited his position as an assistant district attorney. Martin was eventually let go without arrest.
"The issue is not Mr. Martin's past DWAI conviction. It's Mr. Martin using his official position to avoid taking responsibility for his actions. And it's the best indicator of what kind of a district attorney Mr. Martin would be," said Luther.
The Martin campaign has responded with bulk mailings of its own.
A letter from Kirk Martin was mailed to voters where he acknowledged the mistakes he made when drinking and driving.
"I'll be the first to admit that I was drinking too much when I was a younger man," Martin said in the letter. "I made some bad decisions that I am not proud of, including getting behind the wheel after drinking."
Martin has previously stated he admitted his mistake with 2006 plea to DWAI, paid his dues and has not had a drink since.
The Martin campaign also sent a letter from Kirk Martin's mother advocating for her son.
