Norwich, NY (WBNG Binghamton) The defense attorney for Ganesh 'Remy' Ramsaran, 38, of New Berlin, filed a motion to disqualify the Chenango County District Attorney from prosecuting the murder trial.
F. Stanton Ackerman claims the district attorney has a conflict of interest. Ackerman is calling for the appointment of a special prosecutor from outside of the Chenango County DA's office.
Ramsaran was indicted on second-degree murder charges in May in the death of his wife, Jennifer Ramsaran, 36.
The indictment said Ramsaran killed Jennifer on or around Dec. 11 at their home at 449 Sheff Rd. in New Berlin. She was reported missing that same day.
Jennifer's body was found Feb. 26 in the town of Pharsalia.
Ackerman says Ramsaran would be at a disadvantage during trial because the county's Assistant District Attorney Micheal Ferraresse participated in previous civil court proceedings with Eileen Sayles, court records show.
Sayles was having an affair with Ramsaran.
According to court records, Ferraresse questioned Sayles on her relationship with Ramsaran months before Jennifer's disappearance.
Ramsaran's attorney says Sayles is a material witness and Ferraresse's prior knowledge of the situation would be a risk to his case, especially during questioning.
