On Friday, Major Shuta said troopers had no previous encounters with Garnier and never responded to a domestic dispute at his residence on Houck Road until that night.

Delaware County District Attorney Shawn Smith said his office is looking into how they could potentially prosecute Garnier for the death of the unborn child.

He said, that due to how the laws in New York State are set up, there is nothing they can charge Garnier with regarding the unborn child, for now.

“It’s not like you may think or maybe want,” Smith said. “It’s not two murders because the child passed away.”

Smith noted that he seeking to have Garnier indicted for the crimes he is accused of as soon as possible.

Garnier has a felony hearing scheduled at the Delhi Town Court for Sept. 11.

State Police noted that family members will take care of the two children when they are released from the hospital.

This is a developing story.
